E-Warranty for Online Purchases: Legal Validity

Signing warranty documents (illustrative)

Scenario: Mr. Duc buys a TV on a marketplace; the shop sends an “e-warranty” by message: QR-code activation, no paper card. A year later the TV breaks; the brand refuses warranty service for “no original warranty card”. Is the e-warranty valid?

E-warranties carry full legal validity

The Law on E-Transactions 20/2023/QH15 (effective 1 July 2024) recognises data messages’ legal value: electronic documents equal paper documents where meeting conditions (content integrity, identifiable origin, retrievability). E-warranties — whether QR codes, messages, emails or brand-system records — equal paper warranty cards legally. A brand refusing service for “no original card” after issuing e-warranties breaches warranty duties. Consumers should keep: messages or emails containing e-warranty details, activation screenshots, and e-invoices.

Warranty duties do not depend on card form

The Consumer Protection Law 19/2023/QH15 (effective 1 July 2024) sets business warranty duties for warranted goods: receiving and handling warranty claims within committed periods; repair, replacement or refunds per agreement and rules. These duties arise from warranty commitments (advertised “24-month warranty”, sale-contract terms), not from consumers retaining paper cards. Brands and sellers may not impose unreasonable refusal conditions: e.g., demanding “original red-stamped cards” after themselves switching to e-warranty; or refusing because “marketplace purchases aren’t authorised dealers” — distribution channels do not void consumer warranty rights for genuine goods.

Handling online-purchase warranty disputes

Step one: contact the seller or brand via published warranty channels with purchase evidence and e-warranty details. Step two: if unreasonably refused — complain through the marketplace (platforms must support buyer-seller dispute resolution per regulations); report to consumer-protection authorities. Step three: sue for warranty performance and damages. Note limitation and warranty periods: warranty claims exist only within committed warranty terms; expiry ends brand duties (except recall-covered defects). Online buyers should check warranty policies before ordering: duration, scope, nearest service centres.

Frequently asked questions

Lost the e-warranty message?
Contact the brand or seller to look up by phone number, order code or product serial — e-warranty systems store by product, not just by message. That is e-warranty’s advantage over losable paper cards.

Do grey-import or order goods get brand warranty?
It depends on each brand’s policy: many warrant only officially distributed products in Vietnam. Grey-import and order-goods sellers must disclose warranty terms (shop warranty instead of brand warranty) before sale — concealment breaches disclosure duties.

Brand demands shipping the unit to a distant centre — reasonable?
Warranty conditions must be reasonable and pre-notified. Where published policy lists local service centres but the brand forces costly distant shipping, consumers may complain. Some brands authorise provincial service centres to fix this.
