Divorces involving substantial assets are usually far more complex than determining whose name is on the paperwork. Real estate, shares, separately gifted assets, inheritances, offshore assets, loans and cash flows between the parties can intertwine over many years. A good file clearly separates marital property from separate property, the source of funds behind each asset, actual contributions, and transactions showing signs of dissipation or concealment.

Why asset origin matters more than the name on paper

In high-value divorce cases, the decisive question is rarely whose name an asset is in, but where it came from and when. Real estate titled in one person can still be marital property if bought with income earned during the marriage; conversely, separately gifted or inherited assets can remain separate property even if jointly titled.

Preparation therefore centres on reconstructing the money trail: which account the purchase money came from, when, whether there were loans, and who serviced the debt. Bank statements, contracts, receipts and loan files usually persuade more than assertions.

For capital contributions and shares in companies, there is another layer: the value of the stake at formation and at the time of division can differ greatly, and the company charter may restrict transfers to outsiders. From 1 July 2025, Law No. 76/2025/QH15 amended how the market price of shares and capital contributions is determined, so the valuation timing and method should be fixed clearly from the negotiation stage. These factors directly affect the practical division plan.

Preserving assets while the case is pending

The biggest risk at this stage is assets being moved before judgment: sold, gifted, mortgaged, or capital withdrawn from the company. Reviewing the asset position and considering protective measures should therefore happen early, not after the case has progressed far.

We also typically separate two groups of issues to avoid cramming everything into one fight: personal relations and child custody in one group, asset division in the other. For families with businesses, keeping operations undisrupted is often as important a goal as the division outcome.

Marital relations and the spousal property regime are governed by the Law on Marriage and Family 2014 (consolidated text 121/VBHN-VPQH of 2025) and the Civil Code 2015; court procedures follow the Civil Procedure Code 2015. Where the assets are land use rights, housing or capital contributions, the Land Law 2024, the Housing Law 2023 and the Enterprise Law 2020 (amended and supplemented by Law No. 76/2025/QH15, effective from 1 July 2025) also apply.
