“Fast transfers, better rates than banks, no paperwork” — pitches from underground money-transfer rings (FX black markets, triangular “agents”) sound tempting, especially in a hurry. But the price can be lost money + administrative fines + criminal prosecution.
What underground transfers look like
- FX black markets: trading foreign currency with unlicensed individuals/organisations — however good the rate.
- Triangular “agents”: you hand VND to person A in Vietnam; person B abroad hands FX to your family — no banks, no documents.
- Cash couriers: hiring people to carry cash across borders undeclared.
Administrative fines (Decree 88/2019/ND-CP)
- Trading FX at unlicensed organisations: USD 1,000–10,000 → VND 10–20M fines; USD 10,000–100,000 → VND 20–30M; USD 100,000+ → VND 80–100M.
- Carrying FX cash in/out of Vietnam above prescribed levels undeclared: fines up to VND 250M + confiscation (by severity).
When it becomes criminal (Art. 189, 2015 Penal Code)
- Illegal cross-border transport of goods/currency: when illicit values are large enough or after prior administrative penalties — sentences include fines up to hundreds of millions of VND and imprisonment.
- Additionally: flows may be examined as money laundering (Art. 324) if linked to crime.
4 non-legal risks
- 1. Total loss: no contracts, no documents — a vanishing “agent” leaves no one to chase.
- 2. Dirty money: the far-end cash may be criminal proceeds — accidentally becoming a laundering link.
- 3. Rate scams: the “good” pitched rate becomes coercion or counterfeit notes at handover.
- 4. Identity exposure: handing IDs and account details to rings risks identity abuse.
FAQs
In a hurry — banks are slow. Legal fast options?
Yes: lawful international transfer services (Western Union, MoneyGram via licensed banks/agents) — same-day, pricier but safe. Or online bank wires — no branch visit.
Exchanging FX at gold shops?
Only licensed FX agents (licence displayed, usually banks/branches) are lawful — unlicensed gold-shop exchanges violate both sides.
A friend “asks” you to transfer for them?
Risky — undocumented “proxy” transfers are underground-transfer links. Decline, even for acquaintances.
