PIT Finalization for Departing Foreign Experts: What Not to Miss

A foreign expert finishes an assignment and flies home mid-year — then the company gets a notice from the tax authority about an outstanding finalization. A very common FDI scenario: the person is gone, the tax file is open, and any refund has no clear path to the recipient.

This guide systematizes PIT finalization when foreign experts leave, so both the individual and the paying entity stay ahead.

Contents

1. Determine tax residence

The first and most important step — it decides the taxable income scope:

  • Tax resident: present in Vietnam 183+ days in the calendar year or in 12 consecutive months from first arrival; or with a regular residence (permanent registration, or a home lease of 183+ days). Residents are taxed on worldwide income.
  • Non-resident: taxed only on Vietnam-sourced income, with employment income at a flat 20% (no progressive rates, no family deductions).

For experts on 1–2 year assignments, most years are resident years — but the departure year (under 183 days) may flip to non-resident. Recompute year by year.

2. Finalize before departure

The rule: tax residents with employment income must finalize annually. Those departing before year-end must finalize before departure (tax administration rules in Circular 80/2021/TT-BTC).

In practice, many experts leave without finalizing; the tax authority then pursues the paying entity — which is caught off guard while the individual is abroad and hard to reach for documents.

Recommendation: build tax finalization into the offboarding process — the departing expert's handover checklist must include "complete PIT finalization," due 2–3 weeks before the flight.

3. Self-finalize or authorize the company?

Authorizing the paying organization is available when the individual qualifies under Circular 87/2026/TT-BTC (effective 1 July 2026, replacing Circular 111/2013/TT-BTC), typically:

  • Single-source employment income from one paying organization;
  • Still employed there at finalization (or other qualifying cases).

With multi-source income, or having resigned before year-end finalization, the individual finalizes directly with the tax authority of residence/last payer.

For mid-year departures: if the expert leaves for good and is no longer employed at year-end finalization, self-finalization before departure is usually required — authorization is not available. A point many employers get wrong.

4. Dossier and procedure

A PIT finalization dossier for employment income typically includes:

  • The PIT finalization return (current e-tax form);
  • PIT withholding certificates from the payer;
  • Passport (entry/exit stamps to count days of presence);
  • Family deduction and charitable contribution proofs (if any);
  • Power of attorney (if authorizing another person/entity).

File with the tax authority managing the payer, or via the e-tax system. Deadline: the last day of the 4th month after year-end (annual finalization); for pre-year-end departures, finalize before departure.

5. Refunds of overpaid tax

Withheld/paid tax exceeding the liability is refunded on request or offset against later periods. For departing persons:

  • Complete refund procedures before departure;
  • Keep a Vietnamese bank account active to receive the refund, or authorize someone remaining to receive it.

Chasing a "parked" refund from abroad is painful: identity verification, consular-legalized powers of attorney…

6. Double tax treaties

If the expert is a Chinese (or other) tax resident with Vietnam income, the DTA between Vietnam and that state allocates taxing rights, preventing the same income being taxed twice.

The crux is correct treaty residence status under Article 4 (tie-breaker rules for dual residents). Payers should keep supporting files to apply the treaty correctly.

  • Circular 111/2013/TT-BTC (amended by 92/2015/TT-BTC), effective 01/10/2013 — Art. 2 (residence), finalization and authorization rules (cross-check against new-law guidance at implementation).
  • Circular 80/2021/TT-BTC, effective 01/01/2022 — tax administration, pre-departure finalization.
  • Official Letter 1296/CT-NVT of 2026 (Tax Department) — foreigners ending employment contracts in Vietnam declare finalization before exit; if not yet finalized, authorize the payer to finalize on their behalf.

Transition note: finalization for tax year 2026 onward follows the new law. Payers of departing experts in 2026 should verify current return forms and implementing guidance (Decree 253/2026/ND-CP and related documents).
