Entering visa-free then applying for a work permit: allowed?

The “fly in first on the exemption, papers later” route is attractive for urgent hires — and in legal principle it is feasible. But the gap between “feasible” and “safe” is the 45-day clock that starts the moment the entry stamp lands.

The easy part: the labor procedure does not ask about the visa

Decree 219/2025/ND-CP organizes the work permit procedure around the planned labor relationship (position, employer, the employee’s professional documents), not around the current visa symbol. The employer files through the Public Administration Service Center/public service portal within the statutory window (from 60 days to no less than 10 working days before the expected start date). A person lawfully residing on a visa exemption can fully be the subject of that dossier.

The part to plan: converting the residence category after the permit

  • Conversion basis: point c, clause 4, Article 7 of the Entry-Exit Law (sponsored to work + holding a work permit/confirmation);
  • Outcome: an LD visa issued in-country, followed by a 2-year residence card — no mandatory exit leg in the on-time scenario;
  • The implicit time condition: the whole chain must close within the exemption stay’s lawful period — immigration does not issue a conversion visa to a person already overstaying.

When NOT to take this route

  • The employee’s foreign documents are not yet legalized and cannot be completed remotely within a few weeks;
  • The position needs complex demand assessment/approval (multiple work locations, sensitive titles);
  • The company intends to let the employee “start right away” during the wait — this is what turns a valid route into an unpermitted-work violation.

In those cases, the standard order — work permit first (employee still abroad), company-sponsored LD visa, one entry in the right category — is slower on paper but cheaper than every firefighting option.

Practical checklist for the exemption-to-permit scenario

  1. Before the flight: start legalization/apostille of all foreign documents; count the 45-day calendar backwards;
  2. Entry day: record the stay expiry milestone, set an internal alert 15 days ahead;
  3. Inside the window: complete the demand explanation and file the work permit dossier in the first week; never schedule actual work before the permit’s effective date;
  4. When the permit issues: immediately file the residence category conversion + residence card; if progress shows the deadline will be missed, proactively exit on time and re-enter in the LD category — do not let the file carry an overstay mark.

Frequently Asked Questions

Already entered on a visa exemption — can a work permit application be filed?

Yes. The work permit procedure under Decree 219/2025/ND-CP is an independent labor procedure: the employer files at the provincial Public Administration Service Center where the employee will work, and the residence-related condition is that the employee is present/lawfully residing in Vietnam — a unilateral exemption stay (up to 45 days) or a bilateral exemption both satisfy that lawful presence. No rule requires a person on a visa exemption to exit before the employer may file the work permit dossier.

Once the permit issues, how does the switch from exemption stay to the labor category work — is an exit required?

No exit is required in the ordinary case. Point c, clause 4, Article 7 of the Entry-Exit Law allows visa purpose conversion for a foreigner invited and sponsored by an agency/organization to work and holding a work permit or an exemption confirmation. On that basis, the sponsoring employer requests the immigration authority to issue an LD2 visa (or LD1 for a confirmation), followed by a residence card under Article 37 — the whole chain runs in-country during the lawful temporary stay. The point to lock before filing: the conversion must complete while the exemption period is still valid; if the work permit arrives after the exemption expiry, the employee must exit on time and re-enter on a sponsored LD visa rather than overstay waiting for the paper.

What are the risks of the “enter on exemption first, permit later” route?

Three practical risks: (1) time — the work permit cycle needs consular legalization/apostille of the criminal record and professional documents abroad, notarized translation, a demand explanation and 10 working days of processing; with a 45-day window, the plan collapses if the foreign documents are not ready; (2) the “trial work” temptation — every working day before the permit issues is unpermitted labor, fined under Article 13 of Decree 283/2026/ND-CP for both the employee (VND 15–25 million, possibly deportation) and the company (VND 30–75 million by headcount); (3) residence history — consecutive exemption entries to “bridge” the waiting time are scrutinized by immigration and can affect later visa/card assessments.
