IP Protection in Vietnam and Hungary: One Madrid Filing, Two Markets

A practical scenario: a Vietnamese brand sells into Hungary via EU marketplaces. A week later, a competitor registers a similar EU trademark — its goods are seized at customs for “infringement”. The company’s shock: “But I registered my trademark in Vietnam!” — IP protection is territorial: Vietnamese registration doesn’t automatically protect in Hungary.

1. Hungary: gateway to the EU-wide IP system

Hungary’s EU membership means protection there opens the bloc-wide IP system: the EUTM (EU trademark — one filing covering 27 states), the Community design, and the UPC (Unified Patent Court — cross-border EU patent litigation). EU customs run a strong anti-counterfeit mechanism (Application for Action — AFA): rights holders register with customs, suspect goods are held at the border. To sell into the EU, register EU IP first — don’t let competitors file before you.

2. Vietnam: the 2022 IP Law and domestic enforcement

Vietnam protects under the amended IP Law 2022 (07/2022/QH15, effective 1 January 2023) — stronger digital-environment protection, faster application processing. Domestic enforcement runs through specialized inspection, market surveillance, and administrative sanctions; civil suits are growing for major cases. The common oversight: Vietnamese trademark registration protects only in Vietnam — Hungary/EU protection needs separate (or international-system) filings.

3. A “one filing, two markets” strategy

  • Trademarks: the Madrid system — one international filing designating Vietnam and the EU (via EUTM) — cost-saving, centralized management.
  • Patents: the PCT — one international application, national phases in Vietnam and Hungary/the EU (via EPO/UPC).
  • Designs: The Hague — international design registration designating multiple states.
  • Priority: file first at home, then claim priority rights (6 months for marks/designs, 12 for patents) on later filings.
  • Customs: EU customs AFA registration + Vietnam market monitoring — protecting both ends.

IP: register first, sell later
