Personal Debt Collection in Vietnam: 4 Steps to Sue & Enforce

Debt collection

Proper loan paperwork, yet the debtor stonewalls — personal debt collection in Vietnam tests patience: winning the case is one battle, enforcement another. Here’s the practical A-to-Z route.

Personal debt collection: 4 steps

  • Step 1 — Written pressure: demand letters (registered post), messages/emails — set a final 15–30 day deadline. Save everything as evidence.
  • Step 2 — Sue: file at the People’s Court of the defendant’s residence/workplace. Files: petition, loan note, disbursement proof, IDs, collection evidence. First-instance court fees: VND 300,000 for disputes under 6M; percentage-based above (scaled).
  • Step 3 — Win, get the judgment: effective judgments → the loser must comply voluntarily within the deadline.
  • Step 4 — Civil enforcement: non-compliance → petition the district civil judgment enforcement office — seize and auction the debtor’s assets.

Why many “win but never collect”

  • Debtor has no assets: nothing to seize — the judgment becomes paper. Lesson: check assets/repayment capacity BEFORE lending, or demand security.
  • Assets spirited away: debtors transfer assets to relatives pre-suit — ask the court for urgent interim measures (seizure, account freezing) at filing.
  • Slow enforcement: asset verification, valuation, auction — measured in months and years.

Limitations: don’t let them lapse

  • Suit limitation: 3 years from the rights infringement (the unpaid due date).
  • Enforcement request limitation: 5 years from the judgment’s effectiveness.
  • Each written acknowledgement or partial payment restarts the clock.

FAQs

Debtor dares you to “go ahead and sue”?

Do it — many stonewallers pay on receiving the court summons. Filing costs far less than total loss.

Debtor’s whereabouts unknown?

Courts can post public notices and try in absentia — but enforcement is very hard without locatable assets.

Hire a lawyer to collect?

Lawyers send demand letters + map litigation — a firm’s letterhead alone sometimes moves debtors. Fees by agreement.
