Testing, Inspection and Certification: Practical Barriers Beyond WTO

Testing, inspection and certification look widely open on commitment paper — but FDI providers discover a second barrier layer in practice: holding a conformity-assessment business licence is not enough, because your results must also be ‘recognised’ by regulators and customers in each specific field before they are usable.

Two condition layers in conformity assessment services

  • The business licence layer — Decree 107/2016/ND-CP (as amended by Decree 154/2018/ND-CP): certification, inspection, verification and testing services are conditional business lines; providers must register conformity-assessment activities and meet competence, staffing and equipment conditions per registered field.
  • The accreditation layer — accreditation through the Bureau of Accreditation (BoA) system and international recognition arrangements (ILAC/IAF) decides whether a provider’s certificates are accepted in supply chains and export dossiers.
  • The designation layer for state management — for group-2 goods and sector-managed fields (environment, construction, health, agriculture), only results from ministry-designated organisations count for conformity declaration and state inspection procedures; this is the biggest practical barrier for new providers, foreign or domestic.
  • The root product-quality laws — Law on Product and Goods Quality 05/2007/QH12 and Law on Standards and Technical Regulations 68/2006/QH11 frame it: group-2 products need conformity certification by designated organisations — turning ‘designation’ into a de facto market condition.

An FDI entry strategy for testing and certification

  1. Pick fields by the designation map: prioritise voluntary commercial fields (management-system certification, product certification for export) where the group’s international recognition pays off immediately.
  2. Sequence competence: register conformity-assessment activities, obtain BoA accreditation for labs and certification, then seek designation field by field for state-management work.
  3. Consider M&A or a joint venture with a domestic organisation already designated in the target field — buying time and designation position instead of building from zero over years.

In testing, inspection and certification, the licence is only the door ticket; ‘designation’ and ‘accreditation’ are the real playing field. FDI providers who sequence accordingly — enter through voluntary fields and international recognition, build competence, then move into designated fields — avoid the classic newcomer shock: a full licence whose certificates nobody can use.

Frequently asked questions

How open is this sector under WTO?

Conformity assessment has no general foreign equity cap driving access; the real barriers are business conditions under Decree 107/2016/ND-CP plus designation and accreditation by field.

What is the practical barrier?

Designation: for group-2 goods and sector management, only results from ministry-designated organisations count for conformity procedures — newcomers must build competence and win designation field by field.

Can we test export goods?

Yes in voluntary fields and under the organisation’s international recognition; but state quality inspection of imports and conformity declarations still need domestically designated organisations.
